Terms of Service
Part 1. Terms of Service
POLICY | Effective October 26, 2026 | Version 1.6
The agreement and who we are
These Terms of Service govern your subscription to and use of Museum.Studio's Studio Operations software, Museum.Studio-operated websites, hosted catalogue and inquiry features, and related support services that link to these Terms (the Services). The provider is Museum.Studio (we, us, or our). You means the person or business accepting these Terms. If you act for a business, you confirm that you are authorized to bind it.
You accept these Terms by affirmatively agreeing when creating an account or completing a transaction that presents them. We do not treat a visit to a webpage alone as acceptance of a paid subscription. The Subscription Policy and Acceptable Use Policy form part of this agreement. The AI Notice applies when you choose an AI feature. The Data Processing Addendum applies when we process personal information for your studio. Our Privacy Policy explains our processing of personal information; agreeing to these Terms is not consent to every possible use of personal information.
A signed negotiated agreement controls where it expressly overrides these Terms. For personal-information processing on your behalf, the Data Processing Addendum controls any conflict. A checkout confirmation or written promotion controls the particular price, period, and benefit expressly stated there. Mandatory law always prevails.
Eligibility and your account
Subscriber accounts are for people at least 18 years old who can form a binding contract, and for businesses represented by such a person. The initial subscription offering is for US-based customers. Studio Operations is professional software for artists and studios; by subscribing you confirm that you will use the Services for your trade, business, or profession and not primarily for personal, family, or household purposes. This confirmation does not remove a protection that applies to you as a matter of law. You must provide accurate account and billing information, keep it current, protect your credentials, and use individual staff access where available rather than sharing a password. Tell [email protected] promptly about suspected unauthorized access.
You are responsible for activity you authorize and for your staff's use. You are not automatically responsible for unauthorized activity caused by Museum.Studio's failure to meet its obligations. We may request proportionate verification before providing account access, changing a payment connection, exporting private records, or deleting an account. We will not use verification as an unnecessary obstacle to cancellation or privacy rights.
The software and plan limits
Museum.Studio gives you a limited, nonexclusive, nontransferable right to use the Services for your studio during your subscription, subject to your purchased plan and these Terms. We retain rights in our software, branding, and documentation, except for your content and third-party materials.
The plan description and checkout identify included features, users, artwork/storage limits, and charges. No beta feature, roadmap item, demonstration, or third-party integration is included merely because it has been discussed or previewed. Additional paid use requires the disclosed authorization process; exceeding a limit does not authorize undisclosed charges.
Artwork limits count works that are in progress or offered for sale. Sold works never count toward a limit. When you reach your plan's limit, you can upgrade or remove a work before adding another. Nothing is charged without your authorization.
A Free account with no activity in the studio for 90 days may be closed and its records deleted, including sales records. Signing in alone does not count as activity. We send warnings at 30, 60 and 80 days, each with a link to download your records, and a final notice on the day of closing.
Art Writer ("Finish my entry"). Studio and Studio Plus include up to 300 Art Writer drafts a month, Showcase includes up to 100 a month, a trial includes 30 in total, and Free includes 10 in total. Art Writer suggests descriptive text only, such as captions, descriptions and search words. It never changes your artwork facts, prices or availability, and nothing is published until you choose to use it. Please review any text before you publish it. We may adjust these allowances with notice.
We may maintain or improve the Services. We will give reasonable advance notice of a material reduction in core paid functionality, normally at least 30 days when practicable. Where we discontinue a paid service without your material breach, we will refund the unused prepaid portion for the discontinued period. We may make urgent security or legally required changes sooner and explain them when permitted.
Your artwork, content, and ownership
You retain ownership of your artwork, images, descriptions, catalogue, contacts, and other material you provide (Customer Content). Uploading does not transfer your copyright or ownership of physical artwork to Museum.Studio. You represent that you have the rights and permissions needed to store, process, publish, and distribute the material as you instruct, including any photographer's rights and required permissions from depicted people.
You grant Museum.Studio a nonexclusive, worldwide, royalty-free license, limited to providing the Services, to host, copy, transmit, format, make technical adaptations to, back up, and display Customer Content according to your instructions. This includes resizing display images, generating requested documents, serving your catalogue, and using the AI processing you separately choose. We may pass necessary rights to contracted providers only for those purposes. This is not a license to sell your artwork, merchandise it, or use it in Museum.Studio advertisements. Separate affirmative permission is required for a testimonial, featured-artist promotion, or promotional artwork use.
When you delete content using a feature that provides a recovery period, it is removed from normal and public use immediately and retained only so you can restore it during the stated period. During that period, this license is limited to secure storage, requested restoration, and necessary legal or security handling. The license ends when the content is permanently deleted from active systems, except for limited backup, legal, security, and transaction-record copies retained as described in the Privacy Policy and Data Processing Addendum. Restricted retained copies do not authorize continued public display or general-purpose AI training. Third parties may retain copies they lawfully received while material was public; Museum.Studio cannot erase independent downloads or search-engine caches by contract.
You decide what to publish. Review titles, dimensions, prices, provenance, image rights, and all descriptions before publication. Private contact records, costs, internal notes, and private prices must not be intentionally placed in public fields. A shared private link may be forwarded by its recipient; do not treat a link as an identity check unless the feature expressly provides one.
Museum.Studio does not pre-screen Customer Content and has no obligation to monitor it. We may, but are not required to, review, remove, restrict, or suspend material we reasonably believe violates this agreement or the law. Doing so does not make us the author or publisher of Customer Content and does not create a duty to review other material. Nothing in this paragraph limits our obligation to act on unlawful material we become aware of, or to make any report or preservation the law requires.
You are the publisher of everything shown on your public pages, including text an AI feature drafted for you and every factual field you enter or approve. Museum.Studio does not verify artwork facts, authenticity, provenance, condition, price, availability, or the accuracy of any description.
Your collectors and other people's information
You decide why to maintain your own collector, customer, and contact records and must have a lawful basis to supply them, provide required notices, and honor applicable rights. Do not upload passwords belonging to others, full payment-card details, unnecessary government identifiers, sensitive medical data, or other information the Services do not require.
You must not upload government identifiers, full payment-card numbers, health or biometric information, or information about children. If you do, you are responsible for the consequences, and Museum.Studio may remove that material without notice.
We process studio-managed personal information on your instructions under the Data Processing Addendum. We separately process our own subscriber, security, billing, support, and outreach records as explained in the Privacy Policy. Your collection of a buyer's email for an order does not automatically authorize either you or Museum.Studio to subscribe that buyer to marketing.
Artist sales and third-party services
The artist or studio named at checkout sells the artwork. Museum.Studio is not the seller and is not the merchant of record for any artwork. Collector payments are made to the artist's own connected payment provider and do not pass through a Museum.Studio account. Museum.Studio charges a flat subscription fee for software and takes no commission, percentage, or other share of any artwork sale. Museum.Studio supplies software and is not, solely through these Services, the artist's gallery, consignor, insurer, appraiser, escrow agent, or shipping carrier. This description does not override statutory duties imposed on Museum.Studio by its actual activities.
You are responsible for truthful listings, authority to sell, buyer-facing terms, authenticity statements, delivery commitments, returns, refunds, and applicable tax obligations for your own sales. Software-generated invoices, certificates, shipping estimates, and tax calculations depend on the information and configuration used; they do not independently authenticate a work, insure a shipment, or constitute legal or tax advice. A tax calculation does not establish that tax was filed or remitted.
Only integrations currently enabled for your account are offered. Connecting a provider authorizes the specific permissions shown during connection; its separate terms and privacy practices apply. Provider fees, holds, refunds, disputes, eligibility, and settlement timing are governed by the provider and applicable law. Disconnecting an integration may affect checkout or display but does not itself cancel your Museum.Studio subscription. We do not guarantee a third party's uptime or continued compatibility and remain responsible for our own contractual obligations.
AI-assisted features
AI assistance is optional and governed by the AI Notice. Using a supported artwork-writing action may transmit the primary/front image and selected artwork facts or notes to the disclosed AI provider. Additional images are not included in that workflow. Generated text can be inaccurate, similar to other output, or unsuitable. You review it before publication. Museum.Studio does not guarantee copyright protection, originality, sales, valuations, or search placement for generated material.
AI assistance does not authorize inventing or silently changing factual fields such as title, dimensions, materials, price, edition, availability, ownership, or sale status. Refusing optional AI processing does not itself close your account or stop manual use of the otherwise available Services.
Fees and renewals
The Subscription Policy and your checkout confirmation govern subscription payments, renewals, trials, credits, cancellation, and refunds. Before a recurring charge begins, we present the amount, billing frequency, renewal terms, and cancellation method and obtain your express agreement. We will not rely on this paragraph alone as consent to recurring billing.
Security, support, and availability
We use reasonable safeguards appropriate to the personal information and Services we handle. No system can be guaranteed completely secure or continuously available. Keep an independent copy of your important original images and business records. This recommendation does not waive Museum.Studio's security or contractual responsibilities.
Support is provided in writing, through [email protected] and support tickets at support.museum.studio. We do not offer phone or live support. Free includes the help guides; account access, security and legal requests are always answered. Showcase includes the help guides, and if a guide does not solve your question, email support. Studio and Studio Plus include email support for any question, answered first. Unless a separate written service-level agreement applies, we do not promise a particular response time, uptime percentage, data-recovery point, or recovery time. Beta features will be identified and may change or end; paid commitments and mandatory rights still apply.
Suspension, termination, and export
You may cancel renewal under the Subscription Policy and request account closure or deletion separately. Cancelling renewal stops future subscription renewals; it does not normally erase your records immediately.
Suspension means we switch off the affected functionality. Depending on the reason, that can mean taking your public pages offline, putting the account into a read-only state, or disabling a specific feature or integration. Suspension is not deletion and is not cancellation.
We may suspend immediately, without prior notice, where we reasonably believe any of the following applies:
- Child sexual abuse material, or any sexual content involving a person under 18.
- Nonconsensual intimate imagery, or a deceptive intimate depiction of a real person.
- Depictions of torture, killing, or other real violence presented to shock or promote harm, or content that incites or facilitates violence.
- Threats, targeted harassment, or the publication of another person's private identifying information to harass them.
- Forged authenticity or provenance, impersonation of another artist or studio, or falsified transaction records.
- Stolen or unauthorized payment credentials, false identity, money laundering, or chargeback abuse.
- A compromised account, malware, an attempt at unauthorized access, or any other credible and immediate risk to the Services, to other customers, or to their data.
- Repeat copyright infringement after notices handled under the Copyright Policy.
- Conduct that places our hosting, email, or payment-provider accounts at risk of termination or restriction.
- A court order, law enforcement request, regulatory direction, or other legal obligation requiring immediate action.
We may suspend after notice and a reasonable opportunity to resolve the issue, normally seven days, where any of the following applies:
- Non-payment, after the payment-failure notices and retry schedule described in the Subscription Policy have run.
- A violation of the Acceptable Use Policy that is not in the immediate list above.
- Materially false or outdated account, business, or billing information.
- Failure to complete a proportionate verification we have reasonably requested.
- Sustained use above your plan limits after we have asked you to resolve it.
What suspension does and does not do. Suspension takes the affected functionality offline. It does not delete your artwork records, images, collector records, or documents, and it does not shorten the retention periods that otherwise apply. Except where an immediate ground above or a legal obligation prevents it, we keep your login available so you can settle a balance, correct the problem, export your records, or close the account. Deletion happens only at your request or at the end of the closure window described below.
We will tell you the basis for a suspension and how to ask for reinstatement through support, unless disclosure would be unlawful or would compromise safety or an investigation. We restore the affected functionality when the reason for the suspension is resolved. Where a suspension results from your breach of this agreement, we are not required to refund or credit the suspended period. Payment status and suspension remain separate: a suspension is not a hidden cancellation fee and does not authorize new undisclosed charges.
For ordinary termination initiated by Museum.Studio without your material breach, we give at least 30 days' notice and refund the unused prepaid portion after termination. An ordinary account closure includes a 30-day period to request an available-format export of artwork records, stored media, and studio contact records you are entitled to receive. Verified immediate deletion requests, legal restrictions, and serious security risks may shorten or restrict that access. We will explain material exclusions. We do not withhold a legally required privacy export solely because of an unpaid disputed balance.
We may also discontinue the Services in whole on at least 90 days' written notice. In that case subscriptions end on the date stated in the notice, we refund the unused prepaid portion, and the export period described above applies from that date. Discontinuation on that notice is not a breach of this agreement, and our liability arising from it is limited to that refund.
Deletion follows the published retention schedule, legal holds, and backup lifecycle. Ending an account does not erase transaction records legally required by payment providers or relieve either party of obligations already accrued. Terms needed to resolve those obligations, content rights during permitted retention, liability provisions, and dispute provisions survive as necessary.
Warranties and limits of liability
TO THE EXTENT PERMITTED BY LAW, EXCEPT FOR EXPRESS COMMITMENTS IN THIS AGREEMENT, THE SERVICES ARE PROVIDED AS AVAILABLE, WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NOTHING HERE EXCLUDES A WARRANTY, REMEDY, OR LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
To the extent permitted by law, neither party is liable to the other under this agreement for indirect or consequential loss, lost profits, or lost business opportunity. Each party's aggregate liability arising from the Services is limited to the greater of US $100 or the Museum.Studio subscription fees paid or payable by you for the 12 months before the event giving rise to the claim.
These exclusions and cap do not limit fraud, willful misconduct, gross negligence, death or personal injury where liability cannot be limited, mandatory privacy or consumer remedies, amounts validly due for Services, or any other liability the law does not permit us to limit. They do not turn Museum.Studio's express security or data-processing promises into a disclaimer.
If you subscribe on behalf of a business, you will indemnify Museum.Studio against a third-party claim to the extent caused by your unlawful Customer Content, infringement of another person's rights, or material violation of the Acceptable Use Policy. This does not cover Museum.Studio's own wrongdoing. We must promptly notify you, cooperate reasonably, and allow you to control a reasonable defense. No settlement may impose an admission, nonmonetary obligation, or liability on us without our consent. This paragraph does not require an individual consumer to waive nonwaivable protections.
Whether or not you subscribe for business purposes, you are responsible for the Customer Content you upload or publish and for your own sales. If a third party brings a claim against Museum.Studio arising from that content or those sales, you will cooperate with our defense and provide the information we reasonably need. This paragraph does not require an individual consumer to waive a nonwaivable protection, and does not cover Museum.Studio's own wrongdoing.
Disputes and general provisions
Please contact [email protected] to try to resolve a concern. Most problems are settled this way. Informal discussion is encouraged and, except where the arbitration provision below states otherwise, is not a prerequisite to a legally protected complaint, urgent remedy, or timely claim.
Informal resolution first. Before starting arbitration, you and Museum.Studio agree to describe the dispute in writing and allow 30 days to resolve it. This step does not shorten any deadline that applies to your claim.
Agreement to arbitrate. If the dispute is not resolved, you and Museum.Studio agree that it will be settled by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, before a single arbitrator, in Los Angeles County, California, or by telephone, video, or documents only, at your choice where the rules permit it. Judgment on the award may be entered in any court with jurisdiction.
What is excluded. Either party may bring an individual claim in small-claims court. Either party may seek injunctive relief in court to protect intellectual property or address unauthorized access. Nothing in this section waives a claim for public injunctive relief, which remains available in court, or any other right that cannot lawfully be waived.
No class or representative proceedings. Claims are brought individually and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate claims or preside over a representative action, except where consolidation is required by law or agreed by both parties. If this paragraph is found unenforceable as to a particular claim, that claim proceeds in court and the remainder of this section continues to apply.
Costs. Museum.Studio pays the arbitration filing and administrative fees that exceed what you would have paid to file the same claim in court, except where the arbitrator finds the claim frivolous. Each party otherwise bears its own costs unless the law or the arbitrator's award provides otherwise.
Your right to opt out. You may reject this arbitration provision by emailing [email protected] within 30 days of first accepting these Terms, stating your name, account email, and that you opt out of arbitration. Opting out does not affect your subscription, your price, or any other part of this agreement, and we will not treat it as a reason to refuse or restrict service.
If you subscribe for business purposes, a claim arising out of this agreement must be brought within one year after it accrues, to the extent permitted by law. This does not apply to an individual consumer where the law does not permit it, and does not apply to a nonwaivable statutory claim.
California law governs, excluding conflict-of-law rules, except where mandatory law gives you other protection. Subject to those rights and any applicable small-claims jurisdiction, disputes will be brought in the state or federal courts with jurisdiction in Los Angeles County, California. You retain any nonwaivable right to bring a claim in another forum.
We may update these Terms prospectively. For materially adverse changes, we normally provide at least 30 days' advance notice and obtain a new affirmative acceptance when required. Price changes follow the Subscription Policy and applicable renewal-notice rules. We do not apply new terms retroactively to existing disputes without agreement. Security or legal changes may require shorter notice; mandatory rights remain intact.
Neither party's failure to enforce a provision is a waiver. An unenforceable provision is limited or severed only as permitted by law; the remainder continues. We may assign this agreement in whole in a genuine merger, reorganization, or sale of the relevant business, or on the death or incapacity of Museum.Studio's principal, subject to the successor assuming these obligations and to lawful notice. You may not transfer an account to evade eligibility, payment, or security requirements; contact support for a legitimate business transfer.
Neither party is liable for delay or failure to perform caused by an event beyond its reasonable control, including hosting, network, or provider failure, cyberattack, power loss, natural disaster, epidemic, civil disruption, government action, or the serious illness, injury, incapacity, or death of a person essential to operating the Services or of a member of that person's immediate family. Museum.Studio will use reasonable efforts to resume performance and will credit paid time lost to a material outage lasting more than five consecutive days. Payment obligations already accrued are not excused, and this paragraph does not excuse a failure to meet a mandatory legal deadline.
Museum.Studio is operated by a small team and at times by one person. You accept that the Services depend on limited personnel. If a person essential to operating the Services becomes seriously ill, injured, incapacitated, or dies, or must attend to such an event in their immediate family, we may extend response times, suspend affected functionality, or discontinue the Services under the notice and refund provisions above. Where an event of that kind makes the ordinary 90 days' notice impracticable, we will give as much notice as is reasonably possible, stop taking further payments as soon as reasonably practicable, refund the unused prepaid portion, and provide an export period appropriate to the circumstances. Our liability arising from such an event is limited to that refund.
This agreement is between Museum.Studio and you. No collector, buyer, visitor, or other third party has rights under it. A person who buys artwork from you contracts with you, not with Museum.Studio.
Legal correspondence: Museum.Studio, 6210 Wilshire Blvd., Suite 200, Los Angeles, CA 90048. Email: [email protected].
Part 2. Subscription, Cancellation and Refund Policy
POLICY | Effective October 2, 2026 | Version 1.0
This policy covers subscription fees paid to Museum.Studio for its software. It does not set the return terms for artwork purchased from an independent artist. Museum.Studio is the operator of this website and of Studio Operations. Billing help: [email protected].
Before you subscribe
Your order states the plan, included limits, currency, total amount due now, recurring amount or disclosed calculation, billing frequency, renewal date, applicable taxes, any trial or discount end date, and how to cancel. Advertised prices include mandatory Museum.Studio fees; any legally excludable government tax is separately disclosed. Optional extras are separately identified and require your authorization. A monthly equivalent for an annual plan is not a monthly billing option.
Renewal and payment authorization
A recurring plan automatically renews for the period shown at checkout until you cancel. We charge only the payment method and recurring terms you authorize. We send a retainable confirmation showing those terms and a cancellation link. A payment provider may update a saved card under its account-updater services, but that does not revive a cancelled subscription.
We give legally required renewal, promotional-expiry, annual, and price-change notices. Any price increase applies prospectively after appropriate notice and any consent required by law. An existing fixed paid period is not repriced retroactively.
Trials, free plans, and goodwill arrangements
A trial without a payment method does not automatically become paid. A trial with a future charge must show the exact first charge date, amount, frequency, and cancellation method and require separate recurring-billing consent before enrollment. Do not assume a trial exists unless offered in writing.
Students at US schools who confirm a school email ending in .edu get 90 days.
Museum.Studio may grant a complimentary plan, temporary upgrade, courtesy months, or a credit. The written confirmation states the covered plan, start and end conditions, what is charged during the benefit, and what happens afterward. An indefinite complimentary grant means no automatic expiry, not a guarantee that the product will exist forever. Revoking it does not authorize billing without your consent.
A benefit that leads to resumption of an already authorized paid subscription must clearly state the next charge. An account with no paid authorization stays free or stops receiving the paid feature at the end; it is not silently converted to paid. Credits have no cash value unless required by law, are not transferable, and are applied as described in their confirmation.
Cancel, pause, change plan
To cancel renewal, email [email protected]. You can use this route even if you cannot access your account. We provide an alternative authentication route and do not require a telephone call for an online purchase. We do not require a survey, sales conversation, or acceptance of a retention offer before cancellation.
Cancellation stops renewal when processed; access normally continues through the paid period shown in the confirmation. A cancellation submitted before renewal through our designated mechanism should prevent that renewal. If our error causes an additional charge, we correct it. Deleting an application, disconnecting an artist payment provider, or unsubscribing from marketing is not cancellation of the Museum.Studio plan.
If offered, a pause, upgrade, or downgrade includes a preview of its effective date, immediate charge or credit, new limits, and next renewal amount. No extra charge is made before authorization. We do not silently delete artwork because a downgrade leaves the account over quota; the confirmation explains any read-only state or publishing restrictions and the available export/deletion options.
Refunds and failed payments
Except where required by law, expressly offered, or necessary to correct an error, fees for a started billing period are not prorated when you cancel. You can request a goodwill refund through [email protected].
We refund duplicate or unauthorized charges attributable to our error and provide mandatory statutory remedies. A request does not require surrendering a lawful card dispute or other remedy. Approved refunds return to the original payment method where possible; bank/provider processing time varies. A partial refund does not automatically cancel a subscription, and cancellation does not automatically create a refund. We confirm both states clearly.
When payment fails, we notify you of the amount, retry or due dates, update-payment route, and any service restriction date. We may retry validly authorized amounts according to the disclosed schedule and provider rules. We do not impose an undisclosed late fee. Service suspension does not itself delete your records; the Terms describe what suspension does and does not do. The Terms and retention schedule govern closure and export.
Part 7. Acceptable Use and Content Reporting
POLICY | Effective October 2, 2026
Use Museum.Studio lawfully and respect other people's rights. You must not:
- Upload or distribute material that infringes copyright, trademarks, privacy, publicity, or other legal rights, or falsify ownership, authenticity, provenance, availability, or transaction records.
- Publish unlawful sexual material, child sexual abuse material, nonconsensual intimate imagery, or deceptive intimate deepfakes; threaten violence; facilitate exploitation; or disclose private identifying information to harass someone.
- Send unlawful or deceptive messages, ignore valid opt-outs, impersonate others, or use unlawfully acquired contact lists.
- Interfere with systems, upload malware, attempt unauthorized access, evade security or plan limits, or extract private information from another studio.
- Process highly sensitive or regulated information beyond the agreed service scope, circumvent payment-provider restrictions, or use the service for an unlawful transaction.
Lawful artistic nudity is not, by itself, a violation. Rights, consent, legality, age, context, and any applicable provider restrictions still matter. We apply restrictions to the relevant material or functionality where reasonably possible rather than treating all challenging artwork as prohibited.
Report suspected violations at [email protected]. Identify the page or record, the concern, and a safe way to contact you. Do not resend unlawful imagery or unnecessary personal documents. You do not need a Museum.Studio account to report an issue. Copyright claims follow the Copyright Policy; a person harmed by nonconsensual imagery need not own copyright to seek help.
For a nonconsensual intimate-image report under the TAKE IT DOWN process, provide your physical or electronic signature as the depicted individual or authorized representative; identification and location of the depiction sufficient for us to find it; a brief good-faith statement that its publication was nonconsensual, with relevant information supporting that statement; and information sufficient to contact you. You do not need a Museum.Studio account or to own copyright. Do not attach another copy of the image.
Where the TAKE IT DOWN Act applies, we remove the depiction as soon as possible and no later than 48 hours after receiving a valid request through our designated process, and make reasonable efforts to identify and remove known identical copies. Requests go to [email protected]. This route is separate from copyright counter-notice procedures.
Child sexual abuse material. We suspend the affected material and account immediately on becoming aware of apparent child sexual abuse material. We do not delete the material before preserving it as required, we make the report required by law to the National Center for Missing and Exploited Children, and we preserve the associated records for the period the law requires. We do not forward, re-transmit, or ask anyone to resend such material. Do not attach a copy of the material to a report; identify its location instead.
We assess reports, take action required by law, and may remove content, restrict access, preserve necessary evidence, or suspend an account. We notify the affected user and provide a review route where lawful and safe. We do not disclose a reporter's information unnecessarily. Repeat infringement is handled under the Copyright Policy; severe abuse can justify immediate action.
Part 6. AI Assistance and Artwork Permissions
FEATURE NOTICE | Effective October 2, 2026
Artwork-writing assistance
You can choose AI assistance to draft captions, descriptions, keywords, and similar editorial fields. Before the first request, we identify the AI provider and show what will be sent. The approved artwork-writing workflow sends the primary/front artwork image and selected artwork facts or concept notes. It does not send additional artwork images or a private collector list as part of that workflow.
Using this action instructs Museum.Studio and the disclosed provider to process that material for the requested output, subject to the Terms and Privacy Policy. You can use manual editing without selecting the AI action. You can stop future AI requests; this does not recall a request already processed or override a legally required retention period.
You retain rights in your inputs. To the extent Museum.Studio acquires assignable rights in an output generated specifically for you, Museum.Studio assigns those rights to you. This does not guarantee that an output is copyrightable, unique, or clear of third-party rights. We do not claim ownership of your physical artwork or original image because it was analyzed.
Review all output before using it. Do not use generated copy to invent an artist biography, provenance, exhibition, material, edition, sale, or appraisal. Factual artwork fields are not silently rewritten by the artwork-writing tool. You remain able to edit the resulting text. We do not automatically publish a record solely because an AI drafted it.
Providers, training, and support
For information about the AI provider used for a feature, data sent, processing location and applicable retention, contact [email protected]. We identify the provider and information to be sent before you use an AI feature.
Museum.Studio does not use customer artwork, private studio information, or support content to train general-purpose AI models. We use business/API services for customer AI features and do not opt customer content into provider model training. Provider security and application retention can differ from model-training use. A later optional training program would need separate, specific permission, not a silent change to these Terms.
Where support uses AI, the interface discloses it and offers a human review route. AI may help draft or retrieve an answer; it is not legal, tax, financial, or professional advice. Sensitive actions such as refunds, subscription changes, publication, or deletion require the separately authorized workflow. Staff research about prospective customers is a separate processing purpose disclosed in the Privacy Policy, not an instruction from those prospects to run the artwork-writing tool.
Part 8. Copyright and DMCA Policy
POLICY | Effective October 2, 2026
Museum.Studio respects copyright and expects users to do the same. We respond to legally sufficient notices concerning material on systems we control. We may remove or disable access, notify the uploader, and terminate repeat infringers in appropriate circumstances. We accommodate and do not interfere with standard technical measures within the meaning of 17 U.S.C. Section 512. This policy does not guarantee that Museum.Studio qualifies for any statutory safe harbor.
Copyright reports may be sent to [email protected].
Copyright notice
A notice should include:
- Your physical or electronic signature as the copyright owner or someone authorized to act for the owner.
- Identification of the copyrighted work, or a representative list if multiple works at one site are involved.
- Identification and exact location of the allegedly infringing material sufficient for us to locate it, preferably URLs.
- Information sufficient to contact you, including address, telephone number, and email if available.
- A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.
Consider whether the use is authorized by law, including fair use, before sending a notice. Knowingly materially misrepresenting infringement can result in liability. We may forward the notice, including contact information needed for the process, to the affected uploader; do not include unrelated sensitive information.
Counter-notice
If your material was removed through this process and you believe there was a mistake or misidentification, send [email protected]:
- Your physical or electronic signature.
- Identification of the removed material and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief removal or disabling resulted from mistake or misidentification.
- Your name, address, and telephone number; a statement consenting to jurisdiction of the federal district court for the district where your address is located, or, if outside the United States, a judicial district where Museum.Studio may be found; and a statement that you accept service of process from the original notice sender or that person's agent.
We provide a copy of a sufficient counter-notice to the original complainant. Under the applicable statutory process, removed material is restored no earlier than 10 and no later than 14 business days after receipt of a sufficient counter-notice unless our agent first receives notice that the complainant has filed an action seeking a court order restraining the allegedly infringing activity. We may separately restrict material for another lawful policy basis and explain that basis where appropriate.
You may seek independent legal advice before filing a notice or counter-notice. These procedures concern copyright. Privacy, impersonation, safety, and other complaints can be submitted through the content-reporting route without a copyright claim.
Part 11. Artist Storefront and Collector Disclosures
SELLER DISCLOSURE REQUIREMENTS
This is a disclosure framework for artists using Museum.Studio, not Museum.Studio selling their artwork. Each seller needs its own accurate policies and legal review where appropriate. Do not replace the seller's identity or returns address with Museum.Studio's mailbox merely to make checkout look uniform.
Seller identity and terms
Before payment, show: artwork description and exact edition/original status; seller identity; full item price and mandatory charges; permitted separately stated taxes/shipping; currency; delivery territory and time; return/cancellation and damage/loss process; applicable warranties and mandatory rights; and the seller's privacy notice. Identify who is merchant of record and what statement descriptor the buyer will see.
An artist's collector privacy notice must identify the seller, categories collected, order and communication purposes, providers including Museum.Studio, retention, contact/request routes, and applicable rights. A separate marketing opt-in must name the seller. Museum.Studio may provide this framework but cannot verify every seller's facts through a generic policy.
